1. Your acceptance of these Terms
Access to and the use of the Xact Homes (The Company) web site (www.xacthomes.co.uk), referred to as “The System” is subject to these Terms and Conditions. If you do not accept these Terms and Conditions, you must stop using The System immediately. In addition, you will not use The System for any purpose for which is was not intended and any purpose that is unlawful or prohibited by these Terms and Conditions.
In using The System, you are fully accepting these Terms and Conditions and any disclaimers made or contained in The System.
2. Information to Clients and their Contract
The following obligations and responsibilities are incumbent upon each client:
The System is provided by The Company for information purposes only. The Company do not guarantee that information is accurate and cannot be relied upon in relation to any contract entered into with The Company.
The Company reserves the right to modify the contents of The System and any Development and or Property advertised without prior notice.
The user recognises and accepts that The Company provide property price information and other price information based on the information and updates received from clients and business partners around the UK. The Company endeavour to maintain up to date prices, however, we do not guarantee that all prices are accurate and as such, the user accepts information contained within The System may not be up to date.
3. Accuracy of Information
The Company cannot warrant the information as accurate as all information is received via instructions from clients or developers, agents and owners of property.
All decisions taken by users of The System do so at their own risk and therefore information contained within The System should not be taken as advice or recommendation whatsoever.
4. System Changes & Updates
In accordance with our ongoing policy of improvement, The Company reserves the right to update and amend The System. Consequently, The Company can change and remove The System without prior notice and therefore you accept that The Company is not liable to you in such circumstances.
5. Links to Other Systems
The Company intends to limit the available links to Third Party Systems and Web Sites, however, where such links exist, this should not be taken as an endorsement of the same and as such you use the system on this basis. You also accept that The Company is not responsible for the content of any such Systems or Web Sites.

There may also be delays, omissions, or inaccuracies in information contained in this Site. The Company endeavours to make The System available 24 hours per day, however, we are unable to guarantee and warrant that this will be the case. In addition, The Company cannot guarantee uninterrupted use of The System and that the functionality contained within The System will be error free or free from viruses that may be harmful.
The System is provided as seen and without any warranty of any kind, whether express or implied.
Nothing in these Terms and Conditions shall be construed so as to exclude or limit the liability of The Company for the death or personal injury as a result of the negligence of The Company and of that of its employees.
8. Severance
If any of the above Terms and Conditions should be determined to be invalid, illegal or unenforceable for any reason by any court of competent jurisdiction then such Term or Condition shall be severed; however, the remaining Terms and Conditions shall survive and remain in full force and effect and continue to be binding and enforceable.
